Federal Court Mandates Freedom of Kilmar Abrego Garcia from ICE Detention

A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks lawful basis.

"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.

The situation originates in a erroneous deportation to El Salvador in March, which US authorities later admitted was an error. After his repatriation to the United States to answer human smuggling charges, he was held in immigration custody.

In her order, the court noted that the government does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

The court proceedings involve conflicting claims. While the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this claim.

He has also pleaded not guilty to the smuggling counts, which are part of a ongoing criminal case in the state of Tennessee.

The court, who was hearing his challenge to removal in a Maryland district court, determined that he must now adhere to the conditions of his release from jail in Tennessee. This order shifts his monitoring to the Tennessee court.
